Terms and Conditions of Sale
Last updated: 12 October 2026
1. Seller
The Lumette website (lumette.app) is published and operated by Chillax Capital, a simplified joint-stock company (société par actions simplifiée, SAS) with share capital of €1,000, registered with the RCS of Melun under number 808 009 757, whose registered office is located at 54 passée des Vaches, 77630 Arbonne-la-Forêt, France, intra-EU VAT number FR59808009757 (hereinafter "Lumette"). Contact: contact@lumette.app.
2. Purpose
These terms govern the use of the Lumette online service, which helps the customer edit a short film from their photos and videos with the help of artificial intelligence (the "Service"), and the sale to consumers of the export of that film without watermark (the "Film"). Placing an order implies their unreserved acceptance.
3. The Service
Creating a film. The customer creates a film by choosing an occasion, a format (vertical 9:16 or landscape 16:9) and, if they wish, a title and an email address. No account is created: the film is reached through a unique private link. Anyone who holds this link can access the film; the customer keeps it to themselves. If the customer gives their email, the link is sent to them.
Photos and videos. The customer adds their photos and videos, within the limit shown in the film's space. Before upload, their browser shrinks the photos and removes their metadata, location included, and converts the videos, whose kept length is limited. Lumette performs no face recognition.
Editing by artificial intelligence. An artificial intelligence system suggests an edit: chronological order based on the dates of the files, length of each item, transitions, short captions. The customer can move, remove and adjust items themselves, and comment on a thumbnail or on the whole film to get a new version, within the number of versions shown in the film's space.
Music. Instrumental tracks are composed by artificial intelligence (the ElevenLabs service) for the length of the film, and can be regenerated from the customer's comments, within the limit shown in the film's space. The customer may also use their own audio file (a track, a voice memo): this file is read and mixed only in their browser, it is never sent to or hosted by Lumette (see Article 10).
Contributions from family and friends. The customer may share an invite link allowing family and friends to add their photos and videos to the film's library, without an account. The customer can remove this content and close invitations at any time.
Preview and export. The film preview is free and carries a watermark. Payment unlocks the export of the Film without watermark, as an MP4 file, in 9:16 or 16:9. The Film is rendered by the customer's browser, on their own device: how long it takes depends on the device, and a recent browser is required recent Chrome, Edge or Safari (Safari 16.4 or later on iPhone and iPad), Firefox 130 or later. Every exported Film ends with a short notice stating that the editing and music are generated by artificial intelligence.
4. Price
Prices are stated in euros including all taxes on the website and in the film's space, before any payment. Two prices apply:
- the "solo" price, when the film only contains photos and videos added by the customer;
- the "shared" price, when the film contains at least one photo or video added by family or friends through the invite link.
The applicable price is set by the film's content at the time of payment and shown before payment is confirmed. After a payment at the solo price, invitations to family and friends are closed for that film. It is a one-time payment per film, with no subscription.
5. Order and payment
The order is concluded after these terms are accepted, the right of withdrawal is expressly waived (Article 7) and full payment is made by bank card or digital wallet, through Stripe Managed Payments. Payment is collected by Link (a Stripe group service), which acts as reseller and merchant of record for the transaction: it collects the applicable VAT or sales tax, issues the receipt and invoice, and appears on the bank statement as "LINK.COM* LUMETTE". Lumette remains responsible for the Service and for making the Film available.
6. Access to the Film and file retention
As soon as payment is confirmed, the export without watermark is unlocked in the film's space. The customer exports the Film from their browser and saves it on their device or shares it directly.
The film's photos, videos and music are erased from our servers 30 days after payment. After that, the Film can no longer be exported again: the customer is responsible for saving their Film before then. An unpaid film and all its files are erased 30 days after it was created. Lumette is not a backup service: the customer keeps their original files.
7. Right of withdrawal
In accordance with Article L221-28 13° of the French Consumer Code, the right of withdrawal cannot be exercised for the supply of digital content not provided on a tangible medium, where performance has begun with the consumer's prior express consent and express waiver of their right of withdrawal.
Before payment, the customer ticks a box by which they request immediate access to the export of the Film and acknowledge that they lose their right of withdrawal. The customer was able to watch the whole film, with a watermark, before paying.
8. Statutory guarantee of conformity and refund commitment
The Film and the Service benefit from the statutory guarantee of conformity for digital content and services provided for in Articles L224-25-12 et seq. of the French Consumer Code. In the event of a lack of conformity (export impossible on a compatible browser, unreadable file, Film not matching the preview), the customer may obtain that it be brought into conformity or, failing that, a price reduction or termination of the contract.
In addition, if the export does not work and Lumette cannot solve the problem, the customer receives a full refund on simple request to contact@lumette.app within 14 days of payment. The refund is made to the payment method used.
9. Content provided by the customer and by family and friends
The customer warrants that:
- they are the author of the photos and videos they add or hold the rights needed to use them;
- they have the consent of the people recognisable in these images for the use they make of them, in particular when they publish the Film;
- for minors, they act as the holder of parental authority or with that person's consent. The decision to publish a child's image belongs to their parents.
The customer chooses who receives the invite link and remains responsible for the film they put together with that content. Each person who adds photos or videos gives the same warranties for their own content.
Unlawful content is prohibited, in particular content that is hateful, violent, defamatory, sexual or degrading, any sexual or degrading image involving a minor, and content that infringes the rights of a third party (privacy, image rights, copyright). Lumette may refuse to process content, remove it and suspend access to the film concerned.
Any unlawful content can be reported to contact@lumette.app, stating the link concerned and the reason for the report. The customer holds Lumette harmless against any third-party claim related to the content they provided.
10. Music
AI-generated music. The tracks composed for the film are generated by artificial intelligence. The customer may use them with their Film, including in personal posts on social networks. The generator never receives an artist name or a song title: a request to imitate a specific work or artist is not passed on.
The customer's own music. When the customer uses their own audio file, the file never leaves their device: Lumette does not receive, host or distribute it. The customer alone is responsible for their right to use it. A Film containing music the customer does not hold the rights to is for private, family use only. To publish a Film with a well-known song, the customer uses the music library of the publishing platform, which handles the rights.
11. Licence of use
The customer keeps all their rights in their photos and videos. They authorise Lumette to process them only to provide the Service, for the retention period set out in Article 6.
Lumette grants the customer a non-exclusive, free, worldwide licence to use, reproduce and share the elements generated by the Service (edit, generated music, captions) within their Film, for personal and non-commercial purposes, including on social networks. Any commercial exploitation (advertising, resale, paid distribution) is excluded without prior written agreement.
12. Content generated by artificial intelligence
The edit, captions and music are generated by artificial intelligence. The result cannot be predicted or guaranteed in advance. The chronological order depends on the dates recorded in the files, which may be missing or wrong. The customer checks the film in the preview before paying, and can correct it themselves or through comments.
13. Liability
Lumette cannot be held liable for the use made of the Film by the customer or by the people they send it to, nor for content provided by the customer or by their family and friends, nor for the loss of files erased in accordance with Article 6. Lumette's liability is limited to the amount paid for the film concerned, except in the case of gross negligence or wilful misconduct.
14. Personal data
The processing of data is described in the privacy policy.
15. Mediation and disputes
In the event of a dispute, the customer first sends a complaint to contact@lumette.app in order to seek an amicable solution.
These terms are governed by French law, without prejudice to the more protective mandatory provisions of the consumer's country of residence.
